The Creation of States in International Law
The remarkable increase in the number of States in the 20th century did not abate in the twenty five years following publication of James Crawford' s landmark study, which was awarded the American Society of International Law Prize for Creative Scholarship in 1981. The independence of many small territories comprising the ' residue' of the European colonial empires alone accounts for a major increase in States since 1979; while the disintegration of Yugoslavia and the USSR in the early 1990s further augmented the ranks. With these developments, the practice of States and international organizations has developed by substantial measure in respect of self-determination, secession, succession, recognition, de-colonization, and several other fields. Addressing such questions as the unification of Germany, the status of Israel and Palestine, and the continuing pressure from non-State groups to attain statehood, even, in cases like Chechnya or Tibet, against the presumptive rights of existing States, James Crawford discusses the relation between statehood and recognition as it has developed since the eighteenth century. The criteria for statehood and the effect on those criteria of evolving standards of democracy and human rights; their application in international organizations and between States; the creation of States by devolution or recession, by international disposition of major powers or international organizations and through institutions established for Mandated, Trust, and Non-Self-Governing Territories, are also discussed. Apart from the general argument of the normative significance of the legal concept of ' State' , and the analysis of the numerous specific cases, this new edition of a landmark book provides a full and up-to-date account of the general development which has led to the birth of so many new States. Capacity refers to the settlor' s ability to create a trust in the first place; generally speaking, anyone capable of holding property can create a trust. There are exceptions for statutory bodies and corporations, and minors who usually cannot hold property can, in some circumstances, create trusts. Certainty refers to the three certainties required for a trust to be valid. These are that the trust instrument must show certainty of intention to create a trust, certainty of what the subject matter of the trust is, and certainty of who the beneficiaries (or objects) are. Where there is uncertainty for whatever reason, the trust will fail, although the courts have developed ways around this. Constitution means that for the trust to be valid, the property must have been transferred from the settlor to the trustees. For chattels, this can simply be handing the property to them, while transfers of land and shares must be done in writing following certain prescribed forms. HOW LEARNING ORGANISATION PRACTICES CLOSE KNOWLEDGE CREATION
This mismatch, plus a lack of challenge, is shown to undermine an organisation' s ability to recognise or use its knowledge. Four implications are identified: that idea generation becomes less important than idea recognition and use; that knowledge recognition becomes severely limited; that the presence of putative knowledge prevents transformation and that developing learning organisation activities inhibits change. Discussion of three assumptions derived from literature indicates that developing learning processes may not automatically result in useful knowledge. This book discusses whether the pursuit of learning organisation status leads to behaviours that close an organisation to new knowledge. Moreover epistemological study indicates that, whilst the models are assumed to be rational in nature, the organisational knowledge is constructed. Consideration of learning organisation models, power, potential system closure, knowledge levels and individual preferences suggests that instead the outputs may lead to an organisation effectively reversing the knowledge development cycle, effectively closing the system.
